Terms and Conditions - Season Pass Beef Competition

  1.                   The Promoter

The promoter is: PGA European Tour Productions Limited of European Tour Building, Wentworth Drive, Virginia Water, Surrey GU25 4LX.

  1.                   The competition

2.1                The competition involves the submission of an interview question for Andrew Johnston.

  1.                   How to enter

3.1                The competition will run from 20:00 on Monday 8 August 2016 (the "Opening Date") to 12:00 on Wednesday 10 August 2016 (the "Closing Date") inclusive.

3.2                All competition entries must be received by the Promoter by the Closing Date. All competition entries received after the Closing Date are automatically disqualified. The Promoter will not accept responsibility for competition entries that are lost or delayed in transit, regardless of cause.

3.3                To enter the competition, you must submit an interview question for Andrew Johnston via the Promoter’s Facebook, Twitter or YouTube’s official platforms (the “Promoter’s Social Media Platforms”) by the Closing Date.

3.4                No purchase necessary and there is no charge imposed by the Promoter for entry into the competition.

3.5                By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

3.6                The competition entries will be judged by a panel of judges based on the most apt and original answer. The decision of the panel of judges (acting reasonably) will be final. A list of names of the judges can be viewed on www.europeantour.com (the “Website”) from the Closing Date for a period of 30 days.

  1.                   Eligibility

4.1                The competition is only open to all residents in the UK, except:

(a)            employees of the Promoter or its holding or subsidiary companies;

(b)            employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

(c)            members of the immediate families or households of (a) and (b) above.

4.2                In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize.

4.3                If you are under the age of 18, you must obtain written parental or guardian consent to enter and claim your prize. The Promoter may ask the winner to provide proof of age.

4.4                Due to the nature of the prize, the winner must have a golf handicap of 24 or under as at the Closing Date. The Promoter reserves the right to require the winner to provide proof of the handicap and to award the prize to an alternative winner if this condition is not met.

4.5                The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

4.6                In entering the competition, you agree that your entry will be in accordance with the terms and conditions of Facebook, Twitter and YouTube respectively (including, without limitation, YouTube’s Community Guidelines and Terms of Service).

  1.                   The prize

5.1                The prize is participation for one individual only in the Season Pass team at a golf event at North Middlesex Golf Club, London, United Kingdom (the “Venue”) on Friday 12 August 2016. The prize will involve one round of eighteen holes of golf, together with lunch and, subject to availability, the opportunity to interview (at least one question) Andrew Johnston.

5.2                The prize does not include travel insurance, the cost of travel to and from the Venue, accommodation, food and drink (other than the lunch referred to in condition 5.1 above), spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner.

5.3                You will be responsible for ensuring that you are available to travel and hold any necessary insurance and travel documents for travelling to the Venue.

5.4                The prize is subject to availability. There is no cash alternative for the prize. The Promoter reserves the right to vary or replace the prize with an alternative prize of equal value if circumstances beyond the Promoter's control makes it necessary to do so.

5.5                The prize is not negotiable or transferable.

  1.                   Winner announcement

6.1                The winner of the competition will be announced via the Promoter’s Social Media Platforms on Thursday 11 August 2016.

6.2                The decision of the judges nominated by the Promoter is final and no correspondence or discussion will be entered into.

6.3                The Promoter will contact the winner personally as soon as practicable after the Closing Date, using the social media handle provided by the winner when entering the competition.

6.4                The Promoter will send the name and county of the winner to anyone who writes within one month after the Closing Date of the competition requesting details of the winner and who encloses a self-addressed envelope to the address set out in condition 1.

  1.                   Claiming the prize

7.1                The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 24 hours of contact by the Promoter pursuant to condition 6.3, the Promoter reserves the right to offer the prize to the next eligible entrant selected from entries that were received before the Closing Date.

7.2                To claim the prize you must respond to the Promoter’s communications in accordance with, and within the times frames set out in, condition 7.2. The prize may not be claimed by a third party on your behalf.

7.3                The Promoter does not accept any responsibility if you are not able to take up the prize.

  1.                   Limitation of liability

8.1                Insofar as is permitted by law, the Promoter, its agents or distributors (including without limitation, Facebook, Twitter and YouTube) will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

8.2                You acknowledge and agree that the competition is not endorsed, sponsored, administered, associated with or otherwise supported by Facebook, Twitter or YouTube.

  1.                   Ownership of competition entries and intellectual property rights

You agree that the Promoter may, but is not required to, make your entry available on its Website, Promoter Social Media Platforms and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable, royalty-free licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.

  1.               Data protection and publicity

10.1            If you are the winner of the competition, you agree that the Promoter may use your name, image and town or county of residence to announce the winner of this competition and for any other reasonable and related promotional purposes.

10.2            You further agree to participate in any reasonable publicity required by the Promoter (the “Publicity”). You hereby agree that the copyright (if any) and all other rights in and to your Publicity contribution shall vest in and is irrevocably assigned to the Promoter (and this assignment shall operate to the extent necessary as a present assignment of future copyright) and the Promoter shall have the unfettered right to deal with the Publicity in any way it thinks fit. Accordingly you agree that the Publicity may be exhibited or otherwise howsoever exploited (and such exploitation may include the exploitation of ancillary rights therein) in all media and formats throughout the universe for the full period of copyright and all renewals and extensions thereof and thereafter so far as may be possible in perpetuity without acknowledgement or further payment to you. You hereby waive any so called “moral rights” in the Publicity. You hereby agree to complete any further documentation required by the Promoter to give effect to this condition 10.2.

10.3            By entering the competition, you agree that any personal information provided by you with the competition entry may be held and used only by the Promoter or its agents and suppliers to administer the competition.

  1.               General

11.1            If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

11.2            The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

11.3            These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
